We care about your health, safety and comfort. Please read the important information about Stone Bridge Tours health and safety to assess your readiness for a Tour.
To participate in a Tour you will need:
A reasonable level of fitness and strength.
Full body control and hand-eye-foot co-ordination.
The ability to walk independently (unsupported by walking aids)
The following may impact your ability to participate in a Tour safely:
All heart conditions (including high blood pressure).
All respiratory conditions.
Back, limb or joint injuries.
Missing limbs or part thereof, inclusive of prosthetics.
Vertigo, dizziness or loss of balance; visual impairment (except wearing prescription glasses or contact lenses), and learning conditions.
Why? Because the Tour experience includes:
Short walks on uneven natural surfaces and narrow natural passageways.
Exposure to all weather conditions.
Stone Bridge Tours are Full Day or Afternoon 4 wheel drive touring and exploring experiences on our 4,400 acre Snowy Gorge grazing property. Any person over who can sustain moderate physical exertion should find the Tour experience exhilarating.
It is a requirement for every Guest to complete a Declaration and Disclaimer document before touring.
Still concerned? If you believe your health and safety, or that of other Guests, may be put at risk by you taking part, you should not join the Tour. If you have concerns about your ability to participate safely, please consult your treating doctor .
Please be aware that even if you have made a reservation, Stone Bridge Tours reserves the right to decline participation or modify your chosen Touring experience. The health and safety conditions of Tours are subject to change at Stone Bridge Tour’s discretion.
Terms of Trade
The following are the terms of trade (‘Terms’) of Brian W Mitchell ABN 53 812 826 709, trading as Stone Bridge Tours.
Stone Bridge Tours is the seller of all Stone Bridge Tours. By making a reservation with Stone Bridge Tours you acknowledge that you have read and agree to be bound by these Terms.
1. Tours
Stone Bridge Tours reserves the right to add, withdraw, substitute and/or vary advertised routes, prices and departure times for a Tour, without notice. However, reasonable effort will be made to maintain Tours as advertised.
3. Requirements to participate
3.1 Guests must have booked and paid.
3.2 Guests must be of sound mind and be in good health. Every two Children touring, must be accompanied by one paying adult.
3.3 All Guests will be required to sign a Stone Bridge Tours Declaration and Disclaimer Form. The Form includes but is not limited to statements that the Guest has read and understood Stone Bridge Tours health and safety information, which sets out, among other things, the conditions under which Guests should not participate in a Tour. Guests enter Stone Bridge Tour’s premises and participates in a Tour at their own risk.
4. Refusal of participation
Stone Bridge Tours reserves the right to refuse any person, for whatever reason, participation in a Tour, at Stone Bridge Tour’s absolute discretion, whether or not that person has already purchased a Tour. Stone Bridge Tours will reimburse the price paid for a Tour if a person is refused participation for any reason other than as set out above, or other than by reason of breach of clause 5.2 below.
5. During the Tour
5.1 At Stone Bridge Tours ‘discretion, essential medication (e.g. asthma medication or inhalers) may be taken on a Tour. Neither Stone Bridge Tours nor the Guide shall be responsible for the medication or the administering thereof.
5.2 All Guests must obey the directions and instructions of Stone Bridge Tours Guides, must not disturb other Guests or interfere with the Guide’s ability to conduct the Tour in a safe and secure manner, and must not damage, deface or remove any part of the Stone Bridge Tours property or any of the equipment supplied for use on a Tour. Stone Bridge Tours retains the right to remove from a Tour any Guest who does not comply with these Terms, without refund.
6. Miscellaneous Terms
6.1 Photographs supplied by Stone Bridge Tours remain copyright to Stone Bridge Tours, and may only be used or reproduced by the purchaser or recipient for private or domestic purposes, and must not be used for any commercial purpose (including promotion of any supplier or any supplier’s products or services) without Stone Bridge Tours prior written permission.
6.3 Smoking is not permitted in Stone Bridge Tours vehicles.
7. Terms of payment
7.1 The purchase of a Tour is non-refundable, non-transferable and specific to the Tour booked. Tours must not be offered as prizes, offered for sale or resale, or resold or used for any commercial purpose (including, without limitation, promotion of any supplier or any supplier’s products or services) without Stone Bridge Tour’s prior written consent. If Stone Bridge Tours reasonably believes that any other activities have occurred without such consent, the recipient may be refused participation in a Tour, without payment of any compensation whatsoever.
7.2 Reserved Tour times can only be changed up to seven days before the original Tour date, and changed only by time or date to another available time or date. Reduction in the number of Guests or changes to the identity of Guests is not permitted without Stone Bridge Tour’s prior written consent.
7.3 All Tours must be paid for at the time of making the reservation unless otherwise agreed by Stone Bridge Tours in advance, and then only after supplying credit card details for remote payment. Stone Bridge Tours reserves the right to cancel reservations that are not paid for within these credit terms.
8. Cancellation and refunds
8.1 Tours will not proceed should Stone Bridge Tours decide in its absolute discretion, whether for safety reasons or otherwise, to cancel a Tour.
8.2 Should a Tour not proceed, Guests will be rescheduled at their convenience, be issued with a refund voucher in the case of purchases bought through a third party reselling Tours (‘Reseller’) or be reimbursed the price paid for a Tour, but otherwise shall have no claim whatsoever (including no claim for travel expenses or any other out-of-pocket expenses) relating to the cancellation of a Tour. The Reseller will make all reimbursements to the Guest.
8.3 Tours are not refundable, except in accordance with these Terms or as agreed in writing by Stone Bridge Tours. Refunds, when permitted, will only be made to the person or Reseller who purchased the Tour from Stone Bridge Tours.
9. Stone Bridge Tour’s liability
9.1 Nothing in these Terms excludes, restricts or modifies any condition, warranty, right or remedy, implied or imposed by any statute or regulation that cannot lawfully be excluded, restricted or modified, which may include Part V of the Trade Practices Act 1974 (Cth) and corresponding provisions of State or Territory legislation containing implied terms and warranties that operate to protect the purchasers of goods and services in various circumstances. Subject to the last sentence, all express or implied representations, conditions, warranties and provisions, whether based in statute, common law or otherwise, relating to provision of products and services pursuant to or as contemplated by these Terms that are not contained in these Terms, are excluded to the extent permitted by law.
9.2 If any condition or warranty is implied into these Terms under the Trade Practices Act 1974 (Cth) or any equivalent State or Territory legislation and cannot be excluded, and Stone Bridge Tours is able to limit remedy for a breach of such a condition or warranty, the liability of Stone Bridge Tours for breach of that condition or warranty is limited, at Stone Bridge Tour’s absolute discretion, to one or more of the following: in the case of products, to replace the products, supply equivalent products or repair the products, to pay the cost of replacing the products or of acquiring equivalent products, or to pay the cost of having the goods repaired; and in the case of services, to supply the services again or to pay the cost of having the services supplied again. This clause 9.2 is subject to clause 9.3.
9.3 Section 68B of the Trade Practices Act 1974 (Cth) in certain circumstances permits a term of a contract for the supply by a corporation of recreational services to limit liability of the supplier pursuant to section 74 of that Act for death or personal injury relating to that supply. To the extent permitted by section 68B, Stone Bridge Tours limits its liability for death or personal injury relating to the supply of recreational services to A$100,000 per occurrence.
9.4 Subject to clauses 9.1, 9.2 and 9.3 and to the extent permitted by law, Stone Bridge Tours excludes liability and will not be responsible for loss or damage arising from: Guest’s failure to obey Stone Bridge Tour’s safety directions or instructions; any pre-existing medical or psychological condition; any negligent act or omission of Stone Bridge Tours or any person for whom Stone Bridge Tours is responsible; any delay in a scheduled Tour taking place; and any loss of or damage to valuables on Tour.
9.5 Subject to clauses 9.1, 9.2, 9.3 and 9.4, and to the extent permitted by law, Guests release and discharge Stone Bridge Tours from any claim, action, demand or proceeding (including those arising from negligence, to the extent permitted by law) relating to or arising from participation in a Tour.
10. Resellers
When Reseller enters into a sale, reservation or any other transaction, the Reseller shall indemnify Stone Bridge Tours for any loss, damage or expense incurred by Stone Bridge Tours as a result of any misrepresentation, breach of contract by or act of negligence of the Reseller.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Stone Bridge Tours and each purchaser and Guest submit to the non-exclusive jurisdiction of the Courts of New South Wales in respect of these Terms and any dispute between them.

Before joining us on a Stone Bridge Tour, all guests must read the important information in this document, and then sign the declaration and disclaimer below.

YOUR HEALTH AND SAFETY All Guests must read Stone Bridge Tours health and safety information before completing this form. You should not participate in the Tour if you believe your health and safety, or that of other Guests, may be put at risk by you taking part. If in doubt, please speak to a Stone Bridge Tours Guide. Please be aware that even if you feel able to Tour today, Stone Bridge Tours reserves the right to decline participation.
By signing this document I honestly declare that:
1. a) I am aged 18 years or over. b) I am the parent or guardian of an accompanying participant/s aged under 18 years and I have fully explained to them: the risks involved; the requirements listed in this declaration; and how to behave.
2. I have read and understood Stone Bridge Tour’s health and safety information and the Stone Bridge Tours Terms of Trade (‘Terms’). I understand that I may be removed from the Tour, without a refund, if I do not comply with the Terms.
3. I have considered my health and ability to take the tour. I am confident that my health and safety, and that of other Guests, will not be put at risk by me taking part.
4. I will not damage, deface or remove any part of Worongah or any equipment being used by Stone Bridge Tours.
5. I will not disturb other Guests or interfere with the Stone Bridge Tours Guide’s ability to conduct the Tour in a safe and secure manner.
By signing this document I warrant I understand that:
1. The Terms (as displayed and available in printed form) includes important exclusions and limitations of liability and indemnities that I have agreed apply to me and operate to the benefit of Stone Bridge Tours. I understand I may now request a copy of the Terms if I wish to again read that document.
2. I have entered and remain on the premises of Stone Bridge Tours, and I will participate in the Tour, at my own risk.
3. I agree to indemnify Stone Bridge Tours against any loss, damage or claim suffered or brought against them, arising out of or in any way in connection with my participation in a Tour, or a breach by me of the terms of this document or the Terms (to the extent permitted by law).
4. If I suffer any injury or illness, I agree that Stone Bridge Tours may provide evacuation, first aid and medical treatment at my expense, and that my acceptance of these terms and conditions constitutes my consent to such evacuation, first aid and/or medical treatment.
5. Photographs purchased from or supplied by Stone Bridge Tours remain copyright to Stone Bridge Tours. Tour photographs must not be reproduced or used for any commercial purpose, without Stone Bridge Tours prior written permission.
6. I acknowledge that a Stone Bridge Tour is an open air experience, exposed to sun, wind and rain with the potential for cold and wet surfaces, negotiating uneven natural surfaces and narrow spaces; that Australia is home to poisonous species, most common of these are insects, snakes and spiders and that careful observation will help reduce the risk of a bite or sting; that Common sense dictates that ALL animals encountered should be left well alone. Accordingly, I will act at all times with care and prudence to protect the safety of myself and all others. To ensure personal safety I am required to wear sensible clothing during the experience and to wear firmly attached, non-slip shoes.
7. Stone Bridge Tours will rely on this declaration and is not responsible for my decision to participate in the Tour.
8. Stone Bridge Tours reserves the right to refuse any person, for whatever reason, participation in the Tour, in its absolute discretion, whether or not they have previously purchased a Tour.
